Most people equate estate planning with writing a Will. However, a Will is simply one component in the entire estate planning process. A Will only takes effect when you pass on, and it only governs assets which form your estate.
Estate planning is a broader, comprehensive approach to thinking about your legacy. It covers three distinct situations:
A Will addresses the final phase of estate planning, when in practice other phases of life need to be addressed as well. More importantly, planning for these core phases of life enables one to have peace of mind for all situations, both expected and unexpected.
A. Wealth advisory and planning
In Singapore, where asset ownership is high, wealth advisory and planning is an overlooked process which is often simply equated with purchasing certain financial products. However, good wealth planning includes not only managing basic portfolio of assets and products, but also a framework based approach to wealth portfolio construction tailored to an individual's financial goals. It is important to understand the array of instruments available to you to build wealth, generate income, and to take a broad approach to build to your financial goals over time. B. Lasting Power of Attorney (LPA)
Made under the Mental Capacity Act, a Lasting Power of Attorney (LPA) lets anyone aged 21 or over appoint one or more donees to make decisions if they lose mental capacity. It covers two areas: personal welfare, and property and affairs. Without an LPA, your family must apply to court for a deputyship order, which is slower, more expensive, and more stressful. Since 1 April 2026, Singapore Citizens can register a standard LPA (Form 1) with the Office of the Public Guardian free of charge, although certificate issuer fees still apply.
C. Advance Medical Directive (AMD) and Advance Care Planning (ACP)
Made under the Advance Medical Directive Act 1996, an AMD is a document by which a person aged 21 or over, who is mentally capable, refuses extraordinary life-sustaining treatment if they become terminally ill and unconscious. It does not apply while you are conscious and able to decide for yourself, and does not cover any palliative care issues. Advance Care Planning (ACP) is a broader, non-binding conversation with your family and healthcare providers about your values and care preferences, complementing the more formal AMD.
D. Non-Estate Nominations
Certain assets cannot form part of the estate which is dealt with by your Will. In Singapore, this commonly includes CPF savings, property held under joint tenancy, and insurance plans with specific beneficiaries. Nominations for these assets need to be done in an orderly and organized process as part of estate planning.
E. Trusts
Assets placed in a properly constituted trust during your lifetime are no longer yours at death and pass outside the estate. These are uuseful for vulnerable beneficiaries, staged distributions, or cross-border complexity. In general, Trusts are only utilised in situations where the estate is large and significant enough to justify the structuring and running costs.
F. Wills
A Will forms the final act of estate planning, dealing with your estate and its distribution, as well as appointing your executor.
1. Create a long-term plan for your wealth, rather than simply relying on financial products to help you achieve your goals
In general, most people think of wealth planning as simply purchasing certain types of financial products that are more 'long-term' and 'defensive' in nature. Examples of these products include annuity plans, investment-linked plans, and long-term holdings in certain types of funds (which generate consistent yield).
However, most individuals have poor awareness of the inherents risks of these financial products, and more crucially, and often not aware of the fee structures of these products, which often eat away significantly at any gains generated by these products. As such, many individuals are disappointed and confused when the projected gains promised to them do not materialise over time, especially after spending a large portion of their income on such products over the span of many years,

2. Adopt a detail oriented approach to documenting your assets
One of the most common pitfalls in the estate planning process is the lack of documentation and record keeping for assets. Most individuals do not keep an accurate and up-to-date ledger of their core assets, let alone have an easy-to-access record that includes key details of these assets.
In our digital and financialised world, many assets are also often forgotten and excluded in the estate planning process. For example, digital asset wallets and private business interests (equity and/or debt instruments) are often overlooked. Access to these assets is problematic given their private nature.

3. Ensure that there is sufficient coverage and future advice for the people involved in your care or the distribution of your estate
In the full estate planning process, you will be appointing a number of key roles: executor and trustee under the Will, donees under the LPA, guardians for children, nominees for CPF and insurance, and many more. In each instance, the people you appoint should be willing, capable, contactable, and ideally resident in Singapore.

4. Review your will and asset nominations often, especially when there are major life events

While most individuals adopt a 'write and forget' approach to their Wills and nominations, it is critical to review these regularly to ensure that they reflect your latest wishes and plans.
The end-to-end estate planning process has a large number of components and can be complex, confusing, and difficult to manage.
